It does not matter where your company is based. If the output lands in front of people in the EU, you are in scope.

Does your product talk to users through AI, such as a chatbot, an assistant, or a voice interface?

Support widgets, in-product assistants, onboarding bots, and email automations that converse rather than just notify all count.

Would a reasonably attentive person always realize they are talking to AI?

The legal bar is a reasonably well-informed, observant, and attentive person, judged in context. A robot avatar and a cute bot name might not clear it.

Does your product generate content users can see or export, such as text, images, audio, video, or documents?

Tools that only assist with standard editing, a grammar checker for example, ride a carve-out and do not count as generators.

Was that generative feature on the market before 2 August 2026?

This decides whether the machine-readable marking duty applies now or from 2 December 2026.

Do you run emotion recognition or biometric categorisation on people?

Rare for software companies. If yes, this assessment will tell you to call a lawyer. Kindly.

This is the deployer hat: your marketing team drafting with ChatGPT counts, whoever built the model.

Do you publish AI-generated images, audio, or video that could look like real people, places, or events?

Obviously illustrative graphics do not count. Content that appears authentic does.
